The decision of the Constitutional Court of Republic of Srpska no U-26/11 09.26.2012. is extremely important for the realization of children's rights to express their own opinions and participation in every procedure that concerns them.

With this decision, the Court determines that the high school Statute, Rules of Procedure and Regulations on disciplinary and material responsibility of students are not in conformity with the Constitution of Republic of Srpska and the Law on Secondary Education.

The explanation states, inter alia:

Bearing in mind the fact that the position was not requested from the Student' Council when passing disputed general acts, the Court found that these acts were not passed in accordance with the aforementioned provision of Article 7. of the Law on Secondary Education ("Official Gazette of Republic of Srpska" no. 74/08), and accordingly not even with the provision of Article 108. Paragraph 2. of the Constitution of Republic of Srpska, according to which regulations and other general acts must be in accordance with the law, which makes these acts inconsistent with the Constitution and the Law on Secondary Education.

Bearing in mind the provisions of the Law and the stated decision, the Ombudsman for Children reminds that the competent authority of school is obliged to ask from Parents' Council and Student' Council their position and opinion on school's normative acts in writing.

Parents' Council and Students' Council now have the opportunity, in accordance with the powers stipulated by the law, to use their legal opportunity and to influence the content of all normative acts in school.

The Ombudsman for Children of Republic of Srpska will invite Students' Councils to take the initiative in their schools for harmonization of all Rules of Procedure of school with the law and with respect to the obligation of school that in each individual case seek the opinion of the Students' Council and Parents' Council.
